3. Data collection on our website

Cookies

Our website partly uses so-called cookies. Cookies do not cause any damage to your computer and do not contain viruses. Cookies serve to make our offering more user-friendly, effective and secure. Cookies are small text files that are stored on your computer and saved by your browser.

Most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies enable us to recognize your browser the next time you visit.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not combined with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – the server log files must be collected for this purpose.

Registration on this website

You can register on our website in order to use additional functions on the site. We only use the data entered for this purpose for the purpose of using the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise we will refuse the registration.

We use the email address provided during registration to inform you of important changes, such as the scope of the offer or technically necessary changes.

The processing of the data entered during registration is based on your consent (Art. 6(1)(a) GDPR). You can withdraw any consent you have given at any time. An informal email making this request is sufficient. The legality of the data processing already carried out remains unaffected by the withdrawal.

We store the data collected during registration for as long as you are registered on our website, after which it is deleted. Statutory retention periods remain unaffected.

Processing of data (customer and contract data)

We collect, process and use personal data only insofar as it is necessary for the establishment, content or modification of the legal relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process and use personal data concerning the use of our website (usage data) only insofar as this is necessary to enable the user to use the service or to bill for it.

The customer data collected is deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

Local storage in the browser (localStorage, service worker, IndexedDB)

hammhamm.app is a progressive web app that also works offline. For this, your browser stores technically necessary data on your device: a service worker with cached pages, images and recipes you pinned, plus a queue of changes not yet transmitted (e.g. shopping list entries) in localStorage. This data only leaves your device towards our servers and is deleted when you log out. The legal basis is Section 25 (2) no. 2 TDDDG (strictly necessary for the service you requested) in conjunction with Art. 6 (1) (b) GDPR.

Push notifications

If you explicitly enable push notifications (e.g. for shared shopping lists), we store the push address (endpoint) generated by your browser and the associated keys. Delivery goes through the push service of your browser vendor (e.g. Google, Apple, Mozilla), which only receives an encrypted message. The legal basis is your consent, Art. 6 (1) (a) GDPR; you can withdraw it at any time in the settings or in your browser.

Real-time connection (WebSocket)

For live synchronisation of shared shopping lists, your browser opens a WebSocket connection to our own server (Laravel Reverb). Your session data is used to check permissions and list changes are transmitted. No third parties are involved. The legal basis is Art. 6 (1) (b) GDPR.

4. Health data

Processing of health data (Art. 9 GDPR)

Certain optional features of this platform – namely the eating tracker, weight tracking and the daily calorie calculator – process health data within the meaning of Art. 4 No. 15 GDPR, in particular information on body weight, height, meals and calorie requirements. Health data belongs to the special categories of personal data pursuant to Art. 9 GDPR and enjoys enhanced protection.

These features are activated exclusively on the basis of your explicit consent pursuant to Art. 9(2)(a) GDPR. You give your consent in your user profile through a separate declaration of consent; without this consent, the corresponding features remain permanently deactivated.

Your health data is stored exclusively on our servers in Germany and is not passed on to third parties. It is used exclusively to provide you with the tracking features you have requested.

You can withdraw your consent at any time with effect for the future by deactivating the corresponding option in your profile or by sending us an informal email. After withdrawal, the relevant data will be deleted at your request. The legality of the processing carried out until the withdrawal remains unaffected.

5. Use of AI services

For AI-based functions (ingredient recognition on import, ingredient matching, recipe generation from text input, translations and the nutrition assistant) we use language models from European providers. The providers in use may change per function; currently they are the following. Only the recipe texts, ingredient lists or your chat input to the assistant being processed are transmitted. For the assistant, excerpts of your food diary, weight history or inventory may be transmitted at your request so it can answer your questions. Transmission happens server-side; the providers never see your IP address. The providers process the data on our instructions and do not use it to train their models.

Hetzner Online GmbH (Hetzner Inference)

Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (hetzner.com). The models run in data centres in Germany and Finland. A data processing agreement pursuant to Art. 28 GDPR is in place with Hetzner. The legal basis is Art. 6 (1) (b) GDPR.

Mistral AI

For the automatic processing of recipes – in particular the extraction of ingredients from imported recipe texts, the normalization of ingredient names, and AI-assisted ingredient matching – we use the AI API of the provider Mistral AI, 15 rue des Halles, 75001 Paris, France (mistral.ai).

In this process, the recipe texts and ingredient lists you enter or import are transmitted to Mistral AI's servers for processing. The transmission takes place exclusively server-side through our application; your IP address is not disclosed to Mistral AI in this process. A data processing agreement pursuant to Art. 28 GDPR is in place with Mistral AI.

The legal basis is Art. 6(1)(b) GDPR (contract fulfillment), as AI-assisted recipe processing is a core function of the service. Mistral AI processes the data exclusively according to our instructions and does not use it for its own purposes.

Black Forest Labs (image generation)

For the automatic generation of recipe images, we use the Flux service from Black Forest Labs GmbH, Bismarckallee 10a, 79098 Freiburg im Breisgau, Germany (blackforestlabs.ai).

When creating a recipe image, an image description (prompt) generated by us based on the recipe name and content is transmitted to the Black Forest Labs API. No personal data is transmitted in this process; it is exclusively general recipe descriptions. The transmission takes place server-side through our application.

Image generation is based on Art. 6(1)(b) GDPR (contract fulfillment) as part of the recipe management function. Further information can be found in Black Forest Labs' privacy policy at blackforestlabs.ai/privacy-policy.

6. Web analytics

Pirsch Analytics

We use the web analytics service Pirsch Analytics from Emvi Software GmbH, Nickelstraße 1b, 33378 Rheda-Wiedenbrück, Germany (pirsch.io), to collect anonymized information about the use of our website.

Pirsch operates without cookies and without fingerprinting. No persistent user profiles are created. For each page view, the following data is collected server-side and transmitted to Pirsch in anonymized form:

  • URL accessed
  • IP address (used to determine the country of origin and immediately discarded afterwards – not stored)
  • Browser and operating system type (user agent)
  • Referrer (referring page)
  • Browser language

Processing takes place exclusively in aggregated, non-personal form. Identification of individual persons is neither possible nor intended. Pirsch's servers are located in the EU.

The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is to understand the use of our website and improve the service without storing personal data or using tracking cookies.

7. External nutrition data sources

USDA Food Data Central (FDC)

To enrich our ingredient database with nutritional information, we retrieve data from the public API of the United States Department of Agriculture (USDA Food Data Central, fdc.nal.usda.gov). Only general ingredient names are transmitted as search queries in this process – no personal data. The queries are made exclusively server-side by our application; your IP address is not transmitted in this process. The retrieved nutritional data is stored in our database and made available to all users.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in the most complete and accurate nutritional database possible).

Open Food Facts

For the nutritional information of individual branded products, as well as for searching by EAN barcode, we use the public Open Food Facts database (world.openfoodfacts.org). Ingredient names or barcodes are transmitted as search queries in this process – no personal data. These queries are also made exclusively server-side.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in complete product information).

8. Sharing with other users

You release certain data to other users yourself: recipes you mark as public are visible to all visitors of the website together with your display name and may be indexed by search engines. Recipes, shopping lists, food diary, meal plan and inventory can be shared with individual users or your family; they then see the released content and your name. Every release is initiated by you only and can be revoked in the application at any time. The legal basis is Art. 6 (1) (b) GDPR; for health data (diary, weight) it is your explicit consent under Art. 9 (2) (a) GDPR, which you give with the release.

9. Pepesto (shopping list hand-over)

Optionally you can hand your open shopping list over to the app of the provider Pepesto (pepesto.com) to order ingredients there. This only happens when you click the "Order at Pepesto" button. The entries of your shopping list (name and amount) are then passed to Pepesto as a link; your hammhamm.app account is not transmitted. Pepesto's privacy policy applies to the further processing there. In addition we show a non-binding price estimate based on a product catalogue we store ourselves; no data is transmitted to Pepesto for this. The legal basis is Art. 6 (1) (b) GDPR.

10. Hosting and e-mail delivery

Hetzner (hosting)

The application runs on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (hetzner.com) located in Germany. Hetzner processes all data stored in the application and the server log files mentioned above as a processor (Art. 28 GDPR). The legal basis is Art. 6 (1) (b) and (f) GDPR (legitimate interest in secure and reliable provision). More information: hetzner.com/legal/privacy-policy.

Mailjet (e-mail delivery)

E-mails such as confirmation links, invitations and notices are sent through Mailjet, operated by Mailjet SAS, 4 rue Jules Lefebvre, 75009 Paris, France (part of the Sinch group, mailjet.com). Your e-mail address, your name and the message content are transmitted to Mailjet; processing takes place on servers in the EU. A data processing agreement pursuant to Art. 28 GDPR is in place with Mailjet. The legal basis is Art. 6 (1) (b) GDPR. More information: mailjet.com/legal/privacy-policy.

11. Deleting your account and exporting your data

In the settings you can download all data stored for your account as a JSON file at any time (Art. 20 GDPR) and delete your account yourself (Art. 17 GDPR). Deletion irrevocably removes your recipes, images, diary, weight, planning and shopping data and your user account. Content other users shared with you remains with them; your own releases are revoked. Backups are overwritten on a rolling basis, at the latest after 30 days.
